Terms and Conditions

1. Subject matter:

The following terms and conditions apply to all orders received by either telephone, letter, fax or email. In placing the order, the customer accepts said terms and conditions.

Differring, conflicting or additional terms and conditions, or customer's purchasing  rules, are invalid, unless agreed on in writing by Leutwiler-News.

2. Contract:

Leutwiler-News acknowledges and accepts an order by sending an order-confirmation in return, either by mail, fax or email, or by directly sending the goods ordered.

3. Product offers:

All information on our products as seen on these webpages, is nonbinding. In particular, design, colour or technology/functionality, which will improve the item, are subject to change, errors and omissions in descriptions, illustrations and pricing excepted.. All technical information on individual products are based on information provided by the manufacturer and are binding.

4. Payment terms:

All prices are recommended prices, which are continously adjusted to the market. Our currency is the Swiss Franc (CHF) and prices include VAT.

Payment period is 20 days after date of invoice. Leutwiler-News reserves the right to supply, even existing, customers using prepayment or cash on delivery. With the order, customers agree to accept delivery and to pay the full amount due. The costs incurred by noncompliance be borne by the customer.

5. Terms of delivery:

All products on stock are immediately delivered to specified address.

Otherwise, a written order confirmation, which states expected delivery date, will be sent. There is a minimum order value of CHF 25.00. Free delivery for orders of more than CHF 250.00. For orders up to CHF2150.00 there is a fix charge of CHF 9.50 for packing and postage.  Deliveries abroad are on request and against advance payment only.

6. Retention of title:

The goods delivered stay the property of Leutwiler-News until complete payment has been received. Leutwiler-News reserves the right to make the appropriate entry in the registry of title retention. If a customer is in default with payment, Leutwiler-News has the right to withdraw from the contract and to retrieve all goods.

7. Return:

The customer has the right to cancel the contract and return the goods within 10 working days. The products must be returned intact, functional, complete and in perfect original packaging. Failure to meet abovementioned conditions will result in a processing fee. The right of return begins with receipt of the goods by the customer, who also bears expenses of said return.

8. Defects Warranty and Liability:

12 months warranty period for all products on the web, starting on date of purchase. Products will be repaired or replaced free of charge, if the defect is reported within 14 working days after receipt of the goods.

Warranty will be void if repairs or modifications have been made to the product, without written consent from Leutwiler-News. As far as the law permits, liability for damages is excluded. In particular, Leutwiler-News is not liable for damages caused by improper use or natural wear and tear or for any damage not caused to the goods themselves. (Consequential damages)

9. Privacy protection / Solvency check:

Leuwiler-News assures observation of all provisions of Swiss data protection law and the relevant legal standards in the collection, processing and use of personal data.

All customer data will be used solely for internal purposes. A transfer to third party partner organizations will occur only if mandatory to order processing.

Leutwiler-News reserves the right to verify credit standing and identity of the customer, who agrees to this use of his data.

10. Disclaimer:

Despite careful control we assume no liability for the content of external links. Their operators are exclusively accountable for content.

11. Jurisdiction and applicable Law:

These terms and conditions and the contracts placed therein, are subject to Swiss law, excluding purchase right (CSIG).  Jurisdiction is Möriken-Wildegg AG.

12. Final Provisions:

Only the stated version of these terms and conditions at the time of purchase from our internet-shop, are valid. Our terms and conditions are valid, even if they differ from those of the customer. Should any conditions or terms be or become inoperative or invalid, they shall not affect the legal validity of the remaining rules and regulations.

Leutwiler-News also reserves the right to amend these general terms and conditions at any time.
